What bank branch staff can and cannot do — and how to get the best coverage on the open market
Federal Regulations SOR/92-330 — Bank Act
Under Canadian federal regulations SOR/92-330, bank branch staff are prohibited from selling or advising on any insurance product — including life, health and dental, disability, and critical illness insurance. The only permitted exception is Credit Protection Insurance directly tied to a credit product such as a loan or mortgage.

Health & Dental Insurance

Disability Insurance

Critical Illness Insurance

The Only Permitted Exception
Credit Protection Insurance — directly tied to a loan, mortgage, or credit card
This prohibition applies specifically to branch staff. Separately, underwriters in commercial banking or small business lending departments may require a client to obtain certain insurance coverage as a condition of financing. This is a credit condition imposed by the institution to protect its own interests, not a direct sale of insurance by a branch employee.
Practical Example
A dentist investing in their own clinic applies for a business loan — the bank may require Key Person Insurance because the clinic depends entirely on the dentist's presence. If they pass away or become disabled, this insurance ensures the loan is repaid and the clinic continues operating. The bank is entitled to require this coverage — but cannot force you to buy it from them.
Your right is protected: You are entitled to obtain that coverage on the open market through an independent licensed agent — often at better rates and broader terms than what the bank offers.
If the bank requires insurance as loan collateral, an independent policy can be issued on the open market and assigned to the bank as a partial beneficiary (Collateral Assignment) — limited to the outstanding loan balance only. Once the loan is fully repaid, the assignment is revoked and full ownership of the policy returns to the client, with all coverage and accumulated value intact.

Assign the Bank Partially
Bank is beneficiary only up to the outstanding loan balance — nothing more
After Full Repayment
Assignment is revoked — the policy returns to you in full with its accumulated value
Compare credit protection and life insurance for yourself.
| Criteria | Credit Protection Bank-offered | Life Insurance Open Market |
|---|---|---|
| Who owns the policy? | The bank — you are only the insured | You — the policy is entirely yours |
| Who is the beneficiary? | The bank only — to repay the loan | Whoever you choose — family, partner, or any party |
| Coverage amount | Decreases as the loan is repaid | Varies by policy type — and can increase with certain products |
| What happens when the loan is paid off? | Policy ends — no residual value | Policy remains fully in force for the owner |
| Cash value (Whole Life / UL) | None | Accumulates and grows tax-deferred |
| Can you borrow against it? | No | Yes — tax-free (Whole Life / UL) |
| Creditor protection | No | Yes — when a preferred beneficiary is named |
| Medical underwriting | Often none — but exclusions are broader | May be required — but coverage is clearer and more comprehensive |
| Portability if you change banks | Ends when the loan is closed or transferred | Fully independent — unaffected by any banking change |
| Value relative to cost | Often higher cost for declining coverage | Greater long-term value |
